Good day, everyone! I have a friend here in my place who asked me about K3 and i dont have any idea what documents and forms needed. They were married here in Catholic Church last October 2008. He is living here almost a year now and decided to go back to the US and wanted to bring or petition his wife and newly born twins. Please give us some ideas about this matter. Thank you in advance and may God bless everyone.

He should inquire with the U.S. Embassy if he can do a Direct Conselor Filing of the I-130 for a CR-1/IR-1 at the Embassy. If not, then he will need to have a U.S. domicile in order to file. It is recommended that he file for CR-1/IR-1 instead of the K-3, because it does not take significantly longer (maybe an extra month), it is overall less expensive, it is considerably less paperwork and it results in receiving the green card within about a month of arriving in the U.S.

Medical Exams – A caller explained that the civil surgeon who completed the medical exam used the wrong form and then wanted to charge an indigent refugee to reprocess the paperwork on the correct form. What recourse does an applicant have if this occurs?

USCIS Response: Customers should notify the Director of their local office when they have a complaint about a civil surgeon.

Check out this link.

K3 are no longer practical and are dinosaurs.

If the twins are his biological kids they can do CRBAs and they will be US citizens and will only need US passport to get to the US.
Mom has to do the I-130 tho. She may end up with a IR-1 if married for 2 years when she enters the US.
Why is a post from AUG 2009 UP!
